CAPE COD ATM TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern access to and use of the Cape Cod ATM website, online services, forms, content, and related digital services (collectively, the “Services”). The Services are operated by Cape Cod ATM (“Cape Cod ATM,” “Company,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, you should not use the Services.
1. USE OF THE SERVICES
You may use the Services only for lawful purposes. You agree not to violate applicable law; submit false or misleading information; impersonate another person or business; interfere with the Services; gain unauthorized access; introduce malware; scrape, crawl, harvest, or extract information without written authorization; reverse engineer the Services; create unreasonable system burdens; copy proprietary materials; or use Cape Cod ATM information, systems, processes, or proprietary materials to compete with Cape Cod ATM without authorization.
Cape Cod ATM may suspend, restrict, or terminate access to the Services at any time.
2. INFORMATION SUBMITTED TO CAPE COD ATM
You represent that information you submit is accurate and that you have legal authority to provide it.
You grant Cape Cod ATM a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, reproduce, process, analyze, modify, transmit, and otherwise use information and content submitted through the Services for the operation, improvement, development, marketing, analytics, and lawful business purposes of Cape Cod ATM, subject to applicable privacy and data protection laws and our Privacy Policy.
Cape Cod ATM may create aggregated, statistical, anonymized, or de-identified information based on information submitted to or collected through the Services and retains all right, title, and interest in proprietary analyses, models, compilations, insights, reports, systems, algorithms, scoring methods, databases, and other intellectual property created or developed by Cape Cod ATM.
3. DATA AND ANALYTICS
By using the Services, you acknowledge that Cape Cod ATM may collect and analyze information regarding your interaction with the Services as described in the Privacy Policy.
Cape Cod ATM may use lawful analytics and tracking technologies to evaluate website performance, visitor behavior, lead attribution, advertising performance, and business opportunities. Cape Cod ATM may use aggregated or de-identified information for analytics, artificial intelligence, machine learning, research, commercial development, and other lawful business purposes.
4. INTELLECTUAL PROPERTY
The Services and all related content, including text, graphics, logos, designs, software, databases, processes, methodologies, branding, layouts, and other materials, are owned by or licensed to Cape Cod ATM and protected by applicable intellectual property laws.
No ownership rights are transferred to you. You may not copy, reproduce, distribute, sell, license, modify, create derivative works from, or commercially exploit Cape Cod ATM intellectual property without prior written authorization.
5. ATM PLACEMENT INQUIRIES AND BUSINESS OPPORTUNITIES
Information regarding ATM placement, ATM services, revenue opportunities, potential earnings, transaction volume, or other business matters is provided for general informational purposes.
Submission of an inquiry does not create a contract, partnership, joint venture, agency relationship, franchise, fiduciary relationship, or other legal relationship with Cape Cod ATM.
Any ATM placement, equipment purchase, revenue-sharing arrangement, surcharge arrangement, service agreement, or other commercial relationship may be subject to a separate written agreement. If a separate written agreement conflicts with these Terms, the separate written agreement controls regarding its subject matter.
6. NO GUARANTEE OF REVENUE OR RESULTS
Cape Cod ATM does not guarantee transaction volume, ATM usage, surcharge revenue, interchange revenue, profitability, customer traffic, or financial results.
Any examples, projections, estimates, or historical results are not guarantees of future performance.
7. THIRD-PARTY SERVICES
Cape Cod ATM may use or link to third-party services and is not responsible for their availability, accuracy, security, privacy practices, content, or conduct.
8. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CAPE COD ATM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPE COD ATM AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPE COD ATM'S TOTAL LIABILITY ARISING FROM OR RELATED TO A USER'S ACCESS TO OR USE OF THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT ACTUALLY PAID BY THE USER DIRECTLY TO CAPE COD ATM FOR USE OF THE APPLICABLE ONLINE SERVICE DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
10. INDEMNIFICATION
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Cape Cod ATM and its owners, officers, directors, employees, contractors, affiliates, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, misuse of the Services, information or content you submit, violation of law, or violation of another person's rights.
11. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
12. DISPUTE RESOLUTION AND ARBITRATION
To the fullest extent permitted by law, any dispute, controversy, or claim arising from or relating to the Services or these Terms shall be resolved through confidential, binding arbitration on an individual basis in Massachusetts unless the parties agree otherwise in writing.
The parties waive the right to a jury trial to the fullest extent permitted by law. To the fullest extent permitted by law, disputes shall be brought only on an individual basis and not as a plaintiff or class member in a class, consolidated, collective, or representative action.
Nothing in this section prevents Cape Cod ATM from seeking injunctive relief concerning unauthorized access, misuse of intellectual property, confidential information, or interference with the Services.
13. MODIFICATIONS
Cape Cod ATM may update these Terms from time to time. Updated Terms will be posted through the Services with a revised effective date.
14. SEVERABILITY
If any provision is invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in effect.
15. WAIVER
Cape Cod ATM's failure to enforce any provision does not constitute a waiver.
16. ENTIRE AGREEMENT
These Terms, together with the Cape Cod ATM Privacy Policy and any applicable written terms, constitute the agreement concerning use of the Services.

These SMS and Text Messaging Terms apply to text messages sent by or on behalf of Cape Cod ATM.

Where you expressly consent to receive text messages from Cape Cod ATM, you authorize Cape Cod ATM to send messages to the mobile telephone number you provided. Messages may include communications regarding inquiries, ATM placement opportunities, services, account or operational matters, and, where separately authorized or otherwise permitted by law, marketing or promotional communications.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
